Terms of Service
Last updated: April 2026
1. Agreement to Terms
By accessing or using the Setara platform (the “Platform”), operated by Axon Avenue PLT, you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you must not use the Platform.
These Terms constitute a legally binding agreement between you and Axon Avenue PLT (“we”, “us”, or “our”). Please read them carefully.
2. Nature of the Plan
Important: Setara is a legal protection plan provider, not a law firm.
Setara operates a legal protection plan structured as a contract of indemnity within the meaning of Section 77 of the Contracts Act 1950 and falls within the exception provided under Section 37(3) of the Legal Profession Act 1976. Setara provides subscribers with access to a panel of independently practicing, licensed advocates and solicitors. We do not provide legal advice, legal representation, or any legal services ourselves. All legal services are provided by independent panel advocates who are individually licensed by the Malaysian Bar.
The relationship between you and any advocate connected through the Plan is a direct solicitor-client relationship governed by the Legal Profession Act 1976 and the rules of the Malaysian Bar. We are not a party to that relationship.
3. Eligibility
You must be at least 18 years old and a resident of Malaysia to use the Platform. By creating an account, you represent and warrant that you meet these requirements and that the information you provide during registration is accurate and complete.
4. Subscriptions and Fees
Access to the Platform requires an active subscription. The following plans are available:
Individual Plan
RM4.99/month
Single user account
Family Plan
RM14.99/month
Up to 5 family members
- Subscriptions are billed monthly in advance and automatically renew unless cancelled.
- Prices are in Malaysian Ringgit (RM) and inclusive of applicable taxes.
- We reserve the right to change subscription fees with 30 days notice.
- Refunds are handled on a case-by-case basis in accordance with Malaysian consumer protection law.
5. Legal Fees
Your Setara subscription covers access to the Platform and SOS connectivity features only. Any legal fees, professional charges, or disbursements for legal services are agreed upon and paid directly between you and the lawyer. Setara does not set, control, collect, or handle legal fees.
Lawyers on our platform set their own rates and billing practices in accordance with the Solicitors' Remuneration Order 2023 and applicable legal profession rules.
6. SOS Service
The SOS feature is designed to connect you with an available lawyer as quickly as possible during emergencies. However, you acknowledge and agree that:
- Best-effort basis: Connection to a lawyer is provided on a best-effort basis. We cannot guarantee that a lawyer will be available at any given time, particularly during periods of high demand or in remote areas.
- Not a substitute: The SOS service is not a substitute for emergency services (e.g., 999). If you are in immediate physical danger, contact emergency services first.
- Network requirements: The SOS feature requires an active internet connection (Wi-Fi or mobile data). Connection quality depends on your network conditions.
- Location accuracy: GPS location accuracy depends on your device and environmental conditions. We are not responsible for inaccuracies in location data.
7. Recording and Consent
By using the SOS feature, you understand and consent to the following:
- All SOS sessions are automatically recorded (video and audio) from the moment the SOS button is activated.
- Recordings are captured for the purpose of preserving potential legal evidence and are stored securely with SHA-256 cryptographic verification.
- Recordings may capture the faces and voices of third parties present during the encounter (e.g., police officers). This is lawful under Malaysian law when done for the purpose of protecting your legal rights.
- Recordings are retained for 7 years in accordance with legal evidence standards.
- You may request access to your own recordings at any time through the Platform.
8. PIN Protection
Your account is secured with a personal identification number (PIN). You are solely responsible for:
- Keeping your PIN confidential and not sharing it with anyone.
- All activity that occurs under your account using your PIN.
- Notifying us immediately if you suspect unauthorised access to your account.
We are not liable for any loss or damage arising from your failure to protect your PIN.
9. User Obligations
You agree not to:
- Use the Platform for any unlawful purpose or in violation of these Terms.
- Misuse the SOS feature for non-emergency or frivolous purposes.
- Interfere with the operation of the Platform or attempt to gain unauthorised access to our systems.
- Impersonate another person or provide false information.
- Tamper with, alter, or attempt to delete recordings made through the Platform.
- Use the Platform to harass, threaten, or defame any person.
10. Limitation of Liability
To the fullest extent permitted by Malaysian law:
- Setara provides the Platform on an “as is” and “as available” basis, without warranties of any kind, whether express or implied.
- We are not liable for the quality, accuracy, or outcome of any legal advice or services provided by lawyers through the Platform.
- Our total liability to you for any claim arising from or related to the Platform shall not exceed the total subscription fees you have paid to us in the 12 months preceding the claim.
- We are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill.
- We are not liable for service interruptions caused by factors beyond our reasonable control, including internet outages, device failures, natural disasters, or government actions.
11. Indemnification
You agree to indemnify and hold harmless Axon Avenue PLT, its directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Platform, your violation of these Terms, or your infringement of any rights of a third party.
12. Intellectual Property
All content, features, and functionality of the Platform (including but not limited to software, text, graphics, logos, and trademarks) are owned by Axon Avenue PLT and are protected by Malaysian and international intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Platform without our prior written consent.
13. Termination
Either party may terminate this agreement as follows:
- By you: You may cancel your subscription at any time through the Platform. Your access will continue until the end of your current billing period. You may also request full account deletion by contacting us.
- By us: We may suspend or terminate your account with 30 days written notice, or immediately if you breach these Terms.
- Effect of termination: Upon termination, your right to access the Platform ceases. However, recordings made during active sessions are retained in accordance with our data retention policy (7 years) as they may constitute legal evidence.
14. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of Malaysia. Any disputes arising from or relating to these Terms or the Platform shall be subject to the exclusive jurisdiction of the courts of Kuala Lumpur, Malaysia.
Before initiating legal proceedings, both parties agree to attempt to resolve disputes through good-faith negotiation for a period of 30 days.
15. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
16. Entire Agreement
These Terms, together with our Privacy Policy and Data Protection Notice, constitute the entire agreement between you and Axon Avenue PLT regarding your use of the Platform.
